Expert witness reports
When things go wrong defects may occur and disputes may arise. As building surveyors we are ideally placed to provide you with professional advice on property disputes.
We provide independent and joint expert witness reports in accordance with CPR (Civil Procedure Rules) Part 35 and the RICS code of practice. These are either provided to the court to facilitate judgements or supplied to solicitors when compiling case notes.
To comply with CPR part 35 the report must:
- Be written with the surveyor’s primary duty to the court.
- Be independent and unbiased, providing opinion within the surveyors expertise, experience and knowledge
- State the main facts and assumptions, and not omit material facts that might be relevant to its conclusions
- Be impartial and uninfluenced by those instructing or paying them to give the evidence
We will:
- Obtain all documentation and drawings available
- Inspect the property
- Separately meet with the relevant parties to discuss the issues and establish the facts
- Investigate all facts, establish any assumptions and formulate opinions
- Prepare a CPR compliant, well presented, coherent, objective and unbiased report
- Meet with experts and legal advisors to resolve and narrow the issues
- Provide evidence in court if required
